I wouldnt say it looks good, in reality we were really screwed in 2021 when we were told we couldnt exclude the 50m+ in stadium costs, and our stadium costs would have to count towards the clubs P&S.
Id lean towards doomed(to have to have a points deduction).
1. Even if the rules were absolutely stupid, they may have still been the rules we agreed to(like the August 2021 agreement with the league).
2. Then, when the board sent the revision to the commission, they admitted fault and said we were over, but just by 7m. Hard to appeal if you admit fault.
3. Then the last matter is the severity of the punishment. If the commission is correct and the EFL recommends 12 points as the starting point, reduced by mitigating factors(they found our only mitigating factor was how we have been better in recent years), and the premier league has 6 points as a basis, going up for every 5 million over 105m, itll be awfully hard to reduce points very much.
The one hope they may have on appeal to get the points down to a lower number is the fact that the commission expressly said they were rejecting the premier leagues proposed guidelines on points for the sake of showing they are an independent commission that doesn't need to do that, and has wide latitude on punishments......and then gave 10 points which is EXACTLY what the premier league guidelines are(6 points, plus 1 for every 5 mill over).
