“The end of the month” is an approximate period of time. To me it could mean anytime in the last week, but there is no precise definition. It can not be later than the last day of the month. “By the end of the month” means “not later than the last day of the month”; it sets a deadline.

Issue with legal action is that the process takes a long time and Everton would already be relegated before the outcome. The Premier League have created a complete mess.

Relegation is only very likely if we get another deduction on top of no pts back.
