Don't know all the facts here, but didn't Clarkson get away with calling Gordon Brown something similar? I still see him on the idiot box...

You know...[soapbox]If racial vilification is proven to be deliberate & intended to hurt, then I really don't have a problem with the laws however, what I find disturbing is the lack of equity when there is a FALSE allegation. If a person is falsely accused of racial vilification, then they should have the right to seek a similar penalty for the accuser![/spoapbox]

Sharpy, I know that you hate facts, it spoils a good rant. But the truth is the guy was charged with a public order offence including alleged racially aggravated harassment. That's why I doubt the whole "I only called him French line" doesn't really square with the charge.

You also conveniently leave out my comment that I feel that the 3 year ban is disproportionate to the offence.

I'd keep drinking that bleach if I was you, might help your face blend into that white pointed hood thing you wear when you come on here.

I wonder if anyone knows whether he was born out of wedlock, then the statement would be completely factual !
 

So what's the difference then? Not everyone sees it as a Black and White thing, and why is racism any different to calling a Gay man a queer, or calling someone a Chinese ****? They can all be considered offensive, either way. Who's to say it wasn't a French Evertonian who reported him, or someone of French origin?

You can't have one rule for racism and another for lots of different ways to abuse someone, whether it's because of race, gender, Religious beliefs, sexuality or nationality, people will react to things in different ways. There's got to be a level of consistency there.
 
Everyone has different tolerance levels, for instance if i went to the states and watched a Galaxy game, and some Yank in the crowd called Beckham a lazy English [Poor language removed]. I'd probably take offence. And not because i'm Beck's biggest fan or anything, but because he's having a pop at my country. Its the context, its not racist, but it is offensive. He's probably not intended it to sound that way in the heat of the moment but he is incinuating that the French are lazy, with that comment.

Unless there is some other abuse thats not been reported, the punishment doesn't quite fit the crime. I feel for the guy, being a fellow blue, but he's got to expect some punishment, and as i said in the earlier post, its rarely just the one incident that fans get clocked for at the match.
 
Well, personally i have no problem with referring to someone by their nationality or being referred to by mine, providing its in the right context, it can be affectionate. I'm pretty thick skinned though, and if it made someone uncomfortable that would be the end of the matter. It all comes down to what people are prepared to tolerate, and there are differing levels of that from person to person.

But let's not get all pedantic about race and nationality. The insult was singling out his nationality in an offensive way (if not why not just call him a lazy B)

As for PC, well it's a buzz word imo. I consider reporting and punishing racism to be morally correct. I believe we should all be part of the MC brigade
 

According to the UN, it technically would be a form of racial discrimination. Also, as stated above, simply calling him a 'lazy [Poor language removed]' would have achieved exactly the same purported sentiment, so the addition of the 'French' can be nothing other than discriminatory. And also stupid. Let's not forget that - it was a stupid thing to say.

Still, 3 years is a severe penalty. I imagine the thinking behind it is that an example has to be made, so it might as well be made now. I think it could be dealt with a little better.

Well I'm gutted for him too - the PC Brigade has got its way and made a mountain out of a molehill.
Bound over ok, Fined ok, but banned for three years - and banning a man that has hardly missed an Everton game -home, away or abroad for 20 odd years - never been spoken to by the Police anywhere has now been banned for 3 years - not just from Goodison but all matches.
Well for those of you that thought he should be banned you've got your way - for me - the whole verdict stinks but why would anyone be surprised.
It makes me ashamed that a true Evertonian should be treated this way.

Sorry to hear Dave, but can I recommend myp2p, it's your new best buddy.
 
3 years is a crazy punishment, yet I doubt any of us would like someone to call us a lazy bar steward at work. Treat others as you'd like to be treated etc.

He's paid £30-50k a week, whilst the fan pays £50-ish, which for most people is around 20% of their weekly pay, just to watch him.

I'm not saying abuse is justified, but if a fan yells something from the crowd which isn't racist or personal slights on his family etc., then I can fully understand, especially if he was at the time a lazy French [Poor language removed].
 
Saha's paid around £50k a week to play in high pressure circumstances. If I failed to deliver at work, I would expect to be, and have in the past been called, 'lazy' at some point. Saha couldn't give a **** if he heard that. Calling someone a lazy [Poor language removed] serves as a kick up the arse if nothing else.

However, by including 'French' into it, he's set himself up to be singled out for causing offence. In the heat of the moment though he's used it purely as a work to join lazy and [Poor language removed] more fluidly, no harm intended I'm sure.

If it's his first offence, give him a ticking off, everyone in the world given the right conditions makes the wrong remark sometimes. If he does this sort of thing every week on the other hand and it does bother the people sat around him then I have no problems with him being banned.
