These kinds of comments about Gomes baffle me (no opinion on Longstaff so put that to one side). If he can’t run, shoot, tackle or as someone else stated pass a ball further than 10yds. What exactly are the ‘technical’ aspects of football he is good at?

maybe he’s good at FIFA.

Probs starts himself on the bench tho he is scared of trying to create things with his player on that too
 

I have and usually a "gross misconduct clause " will only kick in if allegations are proven.

Of course , parties can agree on anything within a contract but I would be extremely suprised if there was provision within the contract for this scenario and allowing the withholding of wages.......but who knows?
I share your experience, and reached the same conclusion.
 
No mate but i've got a contract of employment and code of conduct that make it very clear the company reserves the right to suspend without pay or terminate my contract based on consequences of particular events.

Nobody really knows, but Everton have the right to suspend him without pay. Depends on many factors that none of us are privvy to tbf.

'There may be legal justifications for the employer to terminate the employee. If he or she is in an at-will state, the employer may have the right to terminate the employee over pending charges. If the employee has a contract, there may be contract provisions related to character, having to report any arrests or the impact of an arrest or conviction.'
1) those events needing to proven, rather than merely alleged? Or is an allegation alone enough? How would YOU react if your employer wanted to include a clause in your contract allowing them to fire you if you were accused of a criminal offence, regardless of whether you had actually been arrested, charged or convicted for it? If you think that's ok, give me your employer's phone number so I can accuse you of stealing my bag of jelly babies (a criminal offence under S.1 Theft Act) and see you suspended without pay immediately.

2) Which is it? Nobody really knows? Or Everton has the right to suspend him without pay?

as to your final paragraph, let's start at the end and work back:

Has he been convicted? No, because that would require being charged, and tried.
Has he been charged? Not to my knowledge. Do you know different?
Has he been arrested? Not to my knowledge. Possibly. Do you know for certain?
Is he an "employee at will"? Do you know what that means, and how it differs from a normal employee's status?

Look, I'm not defending the guy. But he does have a right to due process. Part of that due process would be that he can't be denied a wage SOLELY due to an allegation of wrongdoing. I get that you feel very strongly about this, perhaps due to the nature of the allegation. But I simply don't see how you can so confidently assert that the Club has a right to suspend him without pay when, by your own admission, you have no experience of Employment Law or Contract Law and you haven't got access to the wording of his contract. Whilst I too have not seen his contract, I do have experience in these areas of law (somewhat dated now, granted) and the Law does not ordinarily allow an employer to suspend someone on no pay on the basis of an unproven allegation.

He was a very good technical player before that injury. His close control and ability to carry it. He has totally lost that.

He's decent coming on for the last part of matches. But it means we're in the unenviable position of only 2/6 CMs actually being good enough/fit enough to consistently start Premier League games.

We are really lacking in depth, all across the park. We have a lot of players on the payroll who simply aren't good enough to contribute at PL level with any reliable consistency, which is terrifying when you think of the sheer volume of dead wood that has been tossed away in the last two or three summers.

Any injury to Doucouré or Allan would absolutely cripple us - just like they did last year. We need a decent 3rd CM, to allow for a regular rotation. If we have created the wiggle room to spend the money, I'd love to see us go for Kalvin Phillips in January (almost zero chance, I know) or, if we have to wait until the summer, McTominay from Utd. Given the financial straits we appear to be in however it will almost certainly have to be a loan, in which case a younger player with an option to buy would be a better move - one of the many names previously bandied about from the French League perhaps, someone with some genuine creativity to their game. Whatever we do in January re CM, we also need to buy another one in the summer because that's when Delph goes and his wages come off the books.

Not going to dwell on RB. We need a new one, that's it. Coleman can still do an occasional job in a rotation, but he's running on fumes.

We also need someone to rotate with Townsend on the right - there's simply no option in the squad to play in that area if he is injured. Ideally a younger player comes in with a view to genuinely challenging for the starting spot, and I say that as someone who has been impressed with Townsend thus far.

He was crap mate. Miller played right back and he didn't go at him once.

Dumfries hasnt hit the ground running at Inter either :)

Id like to see us go after the low fee and out of contract players again...RB + CB + CM can be sorted next season with a precontract agreement in Jan or a low cost signing.

Any real cash we have we spend on one top player at right wing. A real gamechanger.

He is, and I won’t defend him if he is like that in a month. However, all players look like they are running in treacle in preseason and he is playing against properly fit players. It’s why we have a pre season.
I'd question that "all players" look like they are running in treacle without a preseason. But let's just say his treacle has been in the fridge.
