I suppose to expand, edit facility only 10 mins.

In theory it can encourage long term growth in a sustainable manner. What with unlimited expenditure in Youth Academy, Infrastructure etc.

Moshiri could build over 10 years the best academy setup in the world and signings aside, the overall infrastructure would be exempt from FFP.

Otoh what's sustainable about €30m in 3 years (UEFA), £39m in 3 (EFL) or £105m in 3 years (PL). Before allowable costs etc. With unlimited cash flow and or equity able to be put in.

I'm pro it on one level as it can reward good management. I would point to Atalanta, to some extent the return of Ajax, Atletico and Borussia Dortmund, perhaps Napoli too. Domestically Brentford and perhaps Brighton.

Otoh, where does stability v growth kick in? Where does one too badly impact the other.

That sounds too much like a plan.

This club don't do planning , not since Moyes early days.
 

I think P&S sending a club in to insolvency is a really bad look on the Premier League, being as the losses are covered at present. The very thing brought in to stop clubs going under is the one thing that is sinking our club..... Ironic really.

Which shows it is not fit for purpose......
What you say is so true. In the sense that P&S regs being enforced sending a club into administration say by an owner losing heart. On one level I totally agree, it would be absurd and nobody wishes insolvency as a consequence.

Otoh should rules be waived as a result. Other clubs who have unequivocally complied and may have lost out would want the punishment for overspending and perhaps an opportunity to claim compensation off the back of it- how do you find the solution within the current rules that satisfies all- well that is a million dollar question.

I keep going back but...
Steve Gibson suing Derby then turning his attention to the EFL then back to Derby. Middlesbrough were apparently compliant in all respects.
Couhig suing Derby over alleged delaying tactics in 2021. Wycome were compliant in all respects.

Peterborough potentially looking at a legal claim v Reading in the event that a -6 is handed down for breaches last year. Peterborough went down by 4 and were compliant in all respects.

Shows how these things can escalate.

I remember calls to waive certain rules in the case of Derby. It is possible that Aston Villa may have had some rules eased in 2018 when taken over...on the verge of bankruptcy and with Projected FFP qs.
 

Humour me.....if it’s an independent body or panel that is reviewing our financial situation then how could they deduct points or fine us as we are not under any jurisdiction to them? I assume they can’t take the action themselves but can recommend that the EPL take the action. If the EPL did that surely Everton’s legal defence would be that the EPL has overseen everything we’ve done the last 4-5 years and so they are equally guilty. And why would the EPL go after a Club who’s every transaction has been overseen by themselves?
It would also seem churlish of the accountants to ridicule the numbers if they’ve signed the accounts off

Not quite.

The Premier League themselves can't deduct the points from a club for such cases- well I suppose they can but Independent Panel are seem as a fairer and more objective way of doing things.

In the Football League when Birmingham were referred it was to an IDC. Same with Derby and Sheffield Wednesday, both sides present their cases and a Panel decide the evidence. Usually goes Independent Disciplinary Commission and then appeal if if reaches that stage is a League Arbitration Panel.

Derby was a bit different in that it went IDC, LAP overturned in favour of EFL.This bit couldn't be appealed the LAP but then back to the IDC to decide sanction which was to restate accounts over a given period by a given deadline. This IDC 2 Sanctioning Hearing could be appealed but neither side did.

Unsure which body decided the Agreed decision but even this had to be ratified independently so in theory a decision agreed by League and Club could have been rejected.

When UEFA banned Man City it wasn't UEFA as such but their Adjudicatory Chamber or similar. Not too familiar with that one.
