Why does it say in almost every media outlet that we can appeal?

Just reading The Athletic article which states BOTH sides can appeal if the PL think it is unduly lenient or we think it's too harsh.

Very early on in the process it was made clear that the decision is final and there's no opportunity to appeal.

Honestly, I forget exactly where it was reported but it was more than one publication.

Like most things Everton, the worst scenario is generally the one that applies so I'll stick with it.

(saying that, if it's a small fine and suspended points deduction we should smile, shake hands and walk away. What a result)

I believe there is no avenue to appeal to a higher court (like CAS) but there is an ability to appeal within the process. I would be very surprised if the boys at the Athletic hadn't read chapter and verse what is possible instead of picking up Chinese whispers and printing them:

But it is also worth pointing out that both sides have a right to appeal and the club would almost certainly do that should the verdict not go their way.

Should either Everton or the Premier League decide to appeal against the panel’s verdict, then there is a process where a separate panel would convene to review any possible appeal.
 
We're not appealing the premier league though. We're appealing an independent commission.

It also talks about the Board, aka The PL, being able to appeal the decisions of the commission.

You could just do a quick google. As the first hit has the answers.

I’ll tell you what it says but I’m sure you will think I’m lying about it and spouting nonsense so you will want to double check I’m sure.

But Portsmouth got 9 points in 2010 taken mid season when they were already 5 points adrift of safety so obviously were relegated.

Middlesbrough got 3 points deducted in 96/97 season and got relegated by 2 points.

I mean, I don’t trust the process at all. and don’t think an appeal would do any good.

As how independent is the Commission anyway? Yes it’s been put together by the Chair of Judicial Panel who is technically an independent person. Yet they are paid by the PL.

Then the Appeal Board is put together by that same Chair.

Is anything really “independent” when it is being sanctioned and paid for by the complainant?

There should be a process to appeal to CAS if not happy with decisions so that it would then be truly independent.
 
The verdict must surely come extremely soon right? You need to know so that you can plan for the rest of the season.

There is a transfer window opening in 7 weeks and we might (we won't, but it's mathmatically possible) be 10 points clear in 20th by then if we are docked 12 points.

The verdict of this could easily determine our style of play for the rest of the season - if we are docked the maximum then Dyche may decide to play less cautiously. knowing that 0-0 draws won't cut it.

It's not a murder case, the facts have been presented and it shouldn't be taking weeks to come to a verdict.

Apparently the main bloke does sit on CAS hearings too:

Murray Rosen KC, a barrister at 4 New Square Chambers, chairs the Premier League’s independent judicial panel and was appointed to the role in 2020.

Rosen’s profile on 4 New Square Chambers’ website describes him as someone who has a “formidable reputation as a tenacious advocate” and as a “neutral who resolves disputes rather than still fighting them”.

In this case, Rosen was expected to select a three-person panel. Because the charges relate to alleged financial breaches, one of the panel members will have been a financial expert.

Rosen is also an arbitrator for the Court of Arbitration for Sport (CAS).
