Of course they have that right. But there is a legitmate questions to say, why has it changed in the last 12 months? What has demonstrably changed in the last 12 months? What guidance has been given to suggest this would happen?

Saying 2 members, who hold a conflict of interest moaned and influenced the decision is not any kind of answer.

I am happy to hear an answer, and of course people can change their view on what is a legitimate write down, but I wouild be intrigued at why something in March 21 was seen as legitimate and in March 22 wasn't. Has there been any change in accountancy law in that time period that we need to be aware of?

I am not sure how any member can be realistically expected to comply with rules, if the regulator in charge of upholding them changes the rules one month to the next, with seemingly no explanation as to why. All anyone can ask is that you are judged to a consistent standard.

I think the answer to your questions are pretty clear, the Covid excuses are no longer valid, and I don’t think there’s ever been any indication that the Covid excuses would continue to be valid for Everton or any other club.

It will be interesting to see what the accounts show. I don’t think the breach will be all that big due to the PL allowing us to have the world’s biggest Covid allowances in recent years.
 
I see. So the PL identify and pick the panel. But its definitely independent. As nothing says independence than the regulator choosing who it wants on the panel.

Sarcasm aside, that is not independent.

Of course, it is Independent as none of the members of the panel will have any affiliation with anyone involved in the case. In effect, they are professional jurors..
 
This was the PL judgement in relation to 6 clubs that went ahead and signed up to a plan to destroy the PL itself...

"The six clubs involved in proposals to form a European Super League have today acknowledged once again that their actions were a mistake, and have reconfirmed their commitment to the Premier League and the future of the English game. They have wholeheartedly apologised to their fans, fellow clubs, the Premier League and The FA. As a gesture of goodwill, the clubs have collectively agreed to make a contribution of £22m which will go towards the good of the game, including new investment in support for fans, grassroots football and community programmes. Furthermore, the clubs have agreed to support rule changes so that any similar actions in the future would lead to a 30 point deduction. Each of the six clubs, in that event, would also be subject to an additional £25m fine."

In light of that, if we got any substantial fine or deduction of points for transgressing the PL's FFP rules (and having been assured by that same PL all was ok) then there's going to be amazement in all quarters of the game in this country.
But it wasn’t a threat to the premier league, the attempted ESL was a threat to European competition, mainly the Champions League.

Outside of the ESL founding clubs there was only going to be 5 other places available via a qualifying competition with the founding clubs always involved regardless of where they finished in their respective leagues the previous season.

It was grossly unfair and the European Leagues quite rightly sided with UEFA because it removed the spirit of competition for teams finishing fairly in European qualifying places.

The teams in England were not intending to leave the premier league only the current Champions League.

If anything it went against the spirit of competition, in the same way as breaking the financial rules of the Premier League could be viewed (whatever our own personal views on this matter may be)

In short, the punishment dealt out to the ESL clubs has no bearing on what is currently happening to us….

( at least if we were blinded to fact that we've been signing off Blank cheques for annual deliveries of cow manure for years now, without bringing anything back in to the club than we could at least be heading into this with some hope of a good Resolution..

Only Everton could get themselves into a situation like this with a 'Supposed' top Accountant at the Helm 🙄

That to me is possibly what has changed. We don't make as much matchday revenue as other clubs with larger stadium capacity and corporate facilities. So, the allowance becomes tougher to defend when those other clubs are releasing financials claiming a lot less.

Ultimately it doesn't really matter why the charge has been levied, what matters is the justification we can spin to defend our position. Hopefully Bill and Denise will leave this to the beancounters rather than inject their unique skillsets and personalities
 
If they get lawyered up properly, not that you can assume that with Everton, then given all of circumstances they can limit the damage here significantly.

I'd actually be more concerned at this point about indirect rather than direct affects. We already get next to nothing in on-field decisions and punishments meted out for failing to control players are disproportionately higher than others, look at the Leeds game.

The PL may look at us an errant child.

Its going to run out of steam because eventually clubs such as our selves will say enough is enough.

They serve the big 6 only.
Once Newcastle make up some fancy sponsorship deals and get involved then it will further underline how they protect the big six and clubs will say enough is enough.

The rules are also there to stop clubs going under. Where would we be if Moshiri could have spent freely the last 5 years? We could be bust now the money has ran out.

The Judicial Panel is set up according to the rules the League members set. Including lawyers itself.

Appointing a commission isn't like determining the outcome of the commission

The people on it are independent of the Premier League with their own day jobs. Prominent law firms and the like.

Individuals governed by codes of conduct like the Law Society etc etc

Yes apologies for me expressing scepticism at the level of independence the Premier League has from The Premier League Judicial Panel.

I wonder who interviews them for their role?

Well respectfully mate, I'm not sure you have answered any of the questions.

To come back on what you have raised, why would "excuses" as you put them be valid last year, but not valid this this? What has changed in the last 12 months to prevent Covid being something that impacted a club? What legal or accounting advise have the league taken to move the goalposts (if they have done).

And yes, I await to see the accounts too.

Its independent but its members are selected by the Premier League?

Forgive me, but when I did jury service, I was employed by, or selected by the prosecution, as this would not in any way an independent legal process.

Hopefully none of the members have any affiliations to teams we rivals with. It needs to be legal people who have no past involvement with football to be fair(er) (as legs face it, at a structural level the whole thing is flawed).

It would have destroyed the domestic leagues as well.
