Messymascot's faith in humanity and ginger safe haven

I'm not even thinking about that....yet. I do believe however that the PL will decide that 777 are not fit and proper owners and there you go. This is in spite of the bar being set so low by Newcastle's takeover.
The comment in the judgement about a fine being unsuitable for clubs with wealthy owners is laughable considering what the sanction for the breakaway 6 was. I'm also fairly sure that if the accounts of every PL team were scrutinised, every single one of them would have some creative accounting going on. It's what accountants do - like small businesses who employ them to minimise the amount of tax they pay. Not illegal but pushing boundaries.
I think you are right 777 probably will pass the test if for no other reason that it would then look to all and sundry that the PL have an agenda against Everton ( however imo they should fail the test based on their track record ).

That said if I were advising them ( luckily for me I'm not !) I'd point out that there are huge risks proceeding with the takeover given that this and other judgements open the door for multiple claims against Everton the potential cost of which are unquantifiable.

Don't get me wrong I'm not saying Leicester, Burnley , Leeds etc will be successful but quite simply we have no idea what if any future damages they could be liable for.
That would have to be priced in to any deal .

If they don't proceed then unless Moshiri continues to fund and /or drops his price so others become interested then I agree with Phil that administration becomes a real possibility.

Everton are truly between a rock and a hard place.

If we don't go into administration then I think that we will stay up this season ( barring a few key injuries).

What happens next season and beyond I have absolutely no idea.

Very scary.

Without being able to go into too much detail, I can say the club are fairly confident that liability would be on the Premier League, rather than ourselves.

The wording of the judgement was aimed to liability being on place ourselves, due to our 'creative' accounting and 'alleged' attempt to deceive the panel.

But, it all boils down to it being the PL's rules and their responsibility to ensure clubs adhere to them, hence why the league worked with us for so long.

They did not give us a punishment last year; the panel also stated we received no sporting advantage during last year, when said clubs went down.

If they want compensation, it's on them, not us.

Hope you are right Phil .

To be Frank I've only skimmed the judgment but was concerned by the passage that said that without commenting on the merits the commission acknowledged that this could entitle individual clubs to bring actions.

That seems consistent with West Ham settling out of court with Sheff U over the Tevez / Mascherano affair and the decision earlier this year involving Leeds and other clubs.

I do seek solace in the commission's comment that Everton did not gain a sporting advantage ( not surprising given our recruitment!) but that seems at odds with them giving us a sporting penalty.

I'll stay retired!

Morning everyone, hope you’re all well. I’ve stopped reading about Everton’s situation it’s too stressful. I literally couldn’t get to sleep on Friday night worrying about this and the dog situation and other minor stresses around me at the moment. It’s bad news when it gets to this, so I’m enjoying reading your educated opinions but staying away from the stuff on social media which is too emotive and probably ill informed.
Great to hear you’re putting up those lights @Armaghtoffee, I love the lights and everything about the build up to Christmas. I’ve been sneaking the odd Christmas ornament out of the cupboard this week and putting them in their place around the house. This Wednesday we are going to Chatsworth House - it’s just stunning at Christmas- we went for the first time last year and had a lovely morning in Bakewell and afternoon at the hall - magical.
I‘m always interested to hear about your music that you listen to and have searched a few of the the newer ones on Spotify.
Have a great Sunday all 💙

Bring us back a tart please Val lol

Morning all, sun coming out but rain forecast for later yet again. Proof of getting old - grandkids are growing up -asked what he would like for Christmas grandkid no1 has requested Gucci Guilty pour homme at around £60 a throw. There was me thinking I could get away with a selection box and a bag of toffees lol.
@Val P I saw a programme about Chatsworth At Christmas preparations it looked amazing. We’ve been to Bakewell a couple times too, it’s lovely there and home (if it’s still there) to one of the husband’s favourite shops - a large hardware store. He spends ages in there - who needs scenery? 🤣
Have a good day, all.💙
