You know what would be better branding?

The badge. A proper full size one.

Or, if they really have to do a mural like a bad Kopite, it could at least be Everton legend(s) - how about Duncan Ferguson celebrating against United, or the Holy Trinity, or this:

It's small time beyond belief to ignore our entire history and put a guy who has been at the club for just 12 months for something like this. And I'm a big Martinez fan!

I'm fairly sure even Martinez would cringe.

Well-known retail brand Jack Wills has successfully relied on its community trade mark of a pheasant (below and left) in infringement proceedings against House of Fraser's use of a pigeon logo (below and right).



The "Pheasant Mark" The "Pigeon Sign"

This case is a useful reminder of how the conceptual similarities between marks, in spite of obvious visual differences, can lead to a finding of infringement. Arnold J's positive findings on likelihood of confusion and unfair advantage were particularly interesting given the lack of evidence adduced by either party. It demonstrates that the courts are very willing to reach independent findings of fact on these issues based on judge lead deduction.








Whereas with Martinez we are fine. He created the slogan he used along with returning the club to its historical brand and heritage

It's an ongoing dispute but the copyright infringement aspect could blow this story up.
 
i know he's got us purring with the way he's made Everton daring, bold and playing with flair but i think it's all a tad premature. if he's got us winning trophies, i'd say go for it. in this modern age, we are quick to elevate and deprecate people on a whim. one football club i care not to mention constantly embarrassed themselves last season by labeling their manager as "The Chosen One" and had put up a silly banner at their theater of nightmares proclaiming him as such...
