Speculated being the operative word.
The beneficial ownership is stated in the accounts prepared in accordance with the Companies Act 2006 and duly audited.
Note the phrase beneficial ownership as this is who ultimately owns them.
In fact at least 5/6ths of "BK's" shares are held by Bill Kenwright 1878 Ltd.
All well and good. But who, if anyone, stands behind that company?

As you say: the operative word is speculation. Personally, I think that what you see with Everton is not what you necessarily get. BK has not operated like a man who controls his assets at the club. In my opinion.
 
Certainly isn't in either the memorandum or the articles.
If it were in either it would be the articles and they certainly don't mention either business.

Limited companies & public limited companies are governed by the Memorandum & Articles of Association, it is the bible basically, & takes lots of effort to amend !!

The beneficial ownership stated in the Everton accounts supports the filings at Companies House that BK owns beneficially 100% of Bill Kenwright 1878 Ltd.
The rest of what you say is your opinion, which I respect your right to hold, but disagree with as it would involve a conspiracy involving auditors, board members and CEO's past and present.

It's a private limited company so at worst the articles require a Special resolution passed by 75%+1 share, so currently as few as 4 shareholders could change the articles.
As the memorandum deals with the original set up of the company showing subscribers, share capital etc, why would you ever change it ?

To let prospective buyers sell off subsidiary businesses that are owned by the Company !

...not necessarily auditors; they can miss things/be misled cant they? When you say board members, do you mean like the bankrupt and completely malleable man with two names, for instance?

I'm arguing from a position of weakness here. I just have a hunch along with many others that the club ownership is not as straightforward as it seems. Maybe (ironically) it's fuelled by a naive belief/hope that if BK was the true master of the club's destiny then he'd have acted in a different manner all these years.

I really hope there's meaningful change whenever it's required in the future - and I know there's well meaning friends of the club that would love to take it on. I just fear there's not going to be a smooth transition and we'll end up with a rudderless ship with ownership in roughly the same hands.
