Times article, Burnley/Leeds threaten to sue Everton

So this is the contract isn't it;


Difficult to see how Burnley and Leeds could compel the Premier League to deduct points imo

The only clear route to a point deduction is if

1. The Prem refers a breach of its rules to a Commission as per section W

E.53, if the PSR Calculation results in losses of in excess of £105m: E.51.1. the Board may exercise its powers set out in Rule E.15; and E.51.2. the Club shall be treated as being in breach of these Rules and accordingly the Board shall refer the breach to a Commission constituted pursuant to Section W of these Rules.

2. The Commission can then deduct points as per section W

[ Commission has the power to]. deduct points scored or to be scored in League Matches or such other matches as are referred to in Rule W.49.4.1;

3. If a club wanted to force the Prem's hand it would have to take the Premier League itself to Arbitration as per Section X. But then it isn't clear the remedies involve point deductions.

The tribunal shall have power to:
X.26.1. determine any question of law or fact arising in the course of the arbitration;
X.26.2. determine any question as to its own jurisdiction;
X.26.3. make a declaration as to any matter to be determined in the proceedings;
X.26.4. order the payment of a sum of money;

X.26.5. award simple or compound interest;
X.26.6. order a party to do or refrain from doing anything;
X.26.7. order specific performance of a contract (other than a contract relating to land); and

X.26.8. order the rectification, setting aside or cancellation of a deed or other document
Prem can't refer the breach now though as they have already decided it isn't a breach. So if they did that, they are admitting they are either corrupt, or incompetent. Sounding a bit like the PGMOL really.

The outcome of this, will likely be an independent regulator gets brought in (already being talked about isn't
?) by the government. By which time, we will be in a new 3 year cycle and have sold a couple of players and be clear of spending issues.
 
Any points deduction for cooking the books would only become applicable from next season anyway, in the unlikely event that it happens. I don’t know why our fans have invented this mad scenario.

It was always the case. It will be forward looking. Any guilt would be established after the season now.

I mean, it's very rare for points deductions to be given.

Other teams have failed FFP rules, and none have had points deductions.

We have not failed a points deduction.
 
Problem is the powers that be, FA For example won't want this as it could open up so many cans of worms if Everton then played a what about them type card.
A president has been set, whatever we have done clubs have done for years, with no come back.
Whoever gets relegated deserves to go for being worse then we were at football

That'll make a change from the 8 years of madness then
 
The points deduction to send us down this season thing has been totally 100% invented by our fans.

Not so, I spoke with a CP fan today and apologised for beating them 3-2…his immediate reply was wait till the points deductions come in. I just can’t understand grown men being such bitter and twisted individuals and lacking in any humour…obviously I expect it off the RS but surely not from no marks supporting a yo yo team like Palace…..

If in the unlikely event the PL admitted they were wrong, it would be awful for them. It could see the resolution of the PL. It would be a huge scandal. There is no incentive for them to do that.

Even if they did though, it would not affect EFC. You would then be failing a PL club, by the rules of an institution that would admitted to being corrupt. We would just be another victim.

The likely outcome is, that these rules get phased out soon, for a different standard of rules anyway.
