Times article, Burnley/Leeds threaten to sue Everton

One particular area of expertise is his ability to analyse and compare.

Ifyou read all of his recent thread you will see that the Everton numbers dwarf every other club that has reported COVID losses over the two years not just by the odd million but by tens if not a hundred million. Had other clubs likewise been claiming anywhere close to the £170 million it’s pretty obvious there wouldn’t be any issues but just for one second ask why Everton’s are so out of step.
They were already below the loss limit just taking out the crystallised Covid losses. The un-crystallised ones, which are irrelevant to statutory accounting, are meaningless to those clubs, so they didn’t spend tens of thousands on external consultants to identify and quantify them.

Not fact, just my assumption. Other clubs could have found more than us. Haven’t we said on top of the 170m, market analysis has highlighted another 50m?

This could literally be that if it was not for Covid we could have sold DCL for 80m, but because we couldn’t sell due to there being no football, he’s now worth 30m. (Not true I know, just an example)

Other clubs had no need to look at such things as their in your face Covid costs already kept them compliant.

If we are taking the pee with the 170m, pretty brazen to say we have another 50m in the bag. But they may have covered us if we didn’t get PP in time so couldn’t capitalise the initial build costs?

That Swiss Rambler blog / string of tweets starts off with the "On the face of it, it does not look good" tone...then it's diluted to a point where debatable claims based on what could possibly be admissible as declared losses are made.

Basically, beyond the colourful spreadsheets, it's not especially better informed than anything we've all been able to muster on this forum.

He's 100% correct on this though: there'll be no quick decision. The magnitude of the consequences means that - regardless of any historical Tevez-WHU example of the speed that a relegation issue can be dealt with - this is punted into the long grass for a very very long time.

Of coursethe claims are debatable and his “ On the face of it claims “ is exactly that I personally however struggle to see why Everton’s numbers could be so out of sync with everyone other club that’s reported numbers .

My point however was that the Swiss Rambler is not just a nerd on Twitter he has is well respected .
 
Sure the PL raised their eyebrows at the Covid losses reported, but indications are that they’ve agreed it with us, on the basis of us reigning in the expenditure, and the PL signing off on our transfers.

If that PL agreement is what’s being challenged, and we’ve had good dialogue with them about it throughout, it would be hard to hold Everton to account, as had the agreement not been there, we could have taken another course of action (I.e sell a player or 2) to balance the books.

The hope is that we’ve been open and honest (enough) with the PL, that we can say we’ve acted in good faith on the basis of that agreement.
 

Of all the commentators , all the bloggers , all the nerds who look at these matters The Swiss Rambler is probably considered to be the go to on such matters.
I am not going to re post his comments but I certainly wouldn’t dismiss anything he says because quite simply he Is an expert unlike most, no all of us

Hes not an expert at all.

Hes a guy who gives his opinions on a social media account.

The experts are the people who sign off on accounts, and say whether any wrongdoing have occurred. Ill take their opinion, as it's what they are qualified to do.

Lie? No. We asked if other stuff could be taken into account as well as the obvious stuff like ale sales. After consideration, and I assume external expertise, the PL said "yes".

Its like when I was self employed. As I didnt have an accountant, I could call HMRC and ask if I could use some expenses to offset my tax. They say Yes, great. If they say No, I pay up. Different scales, but thats essentially what we did.
 
When a commission is appointed once a complaint has been lodged it has to be formed as follows

As soon as reasonably practicable following receipt of a complaint, the Chair of the Judicial Panel shall appoint a Commission to hear the complaint, confirm the identities of the Commission members to the Board and the Respondent(s) and require each appointed individual to complete a statement of impartiality in such form as the Chair of the Judicial Panel shall prescribe. Where a party objects to one or more of the appointments made to the Commission, it must raise such objection within two Working Days of the relevant appointment(s), which shall be resolved by the Chair of the Judicial Panel in such manner as he/she thinks fit.
