6 + 2 Point Deductions

Woke up this morning still not fussed by the points deduction. Reckon it could have been 15 points and we'd still be fine this season, the promoted 3 are just that poor.

As long as the same approach is applied to City and Chelsea I'm fine with it. Seeing those two relegated will drag us back up the ladder by the same number of places this points deduction will cost us.in prize money stakes anyway.

The upcoming compensation claim is a good deal more alarming. It would be nice to know just how alarming so we can stop losing unnecessary sleep over that and plan for next season.

Wasn’t it determined that we gained so sporting advantage? So what case do they have to sue us? Still haven’t heard an explanation that makes sense as to how they could sue us and not the Premier League.

You think those cases will be heard this season?

And you think relegation is a remote possibility for one of their brand clubs?
 

What is the appeal process and who do we appeal to?
Apparently it's heard and judged on within 2 months of it going in...just how long EFC will take on this we don't know.

I suspect that the club know it'll be forlorn and are just avoiding dealing with this right now by kicking it down the road.
 
BTW, I cant bring myself to click on their site, did the PL have any message to the fans of Everton yesterday explaining why they've pushed to have their club relegated? Given they're so mindful of fans and all that they surely would have had some message of consolation, sympathy, reasoned explanation for Everton fans.

Exactly.
How can they prove in a lawcourt that we got more points than they did due to having too much debt.?

I will keep emphasising this point because it's not being talked about enough in what i am reading media wise. In the report:

'In the Complaint the Premier League had asked for an expedited hearing so that the proceedings could be concluded before the end of the 2022/2023 season. That application was determined at a Teams hearing on 31 March 2023. The Commission decided that it was unrealistic to expect these proceedings and any appeal to be determined in the current season – and that to compel Everton to attempt to meet such a timetable would run the risk of procedural unfairness. Conventional directions were agreed, with the substantive hearing to take place in the autumn of 2023, which would permit any appeal to be heard and determined in the 2023/2024 season.'

The PL tried to influence the timeframe to meet their agenda, to have the points deduction last season which would have relegated us. What they asked for in expediting the process would have caused, in the words of the commission' procedural unfariness'.

They didn't want a fair process, they wanted a fast track punishment for us. They tried to engineer an unfair process and that should form part of our appeal, that the PL tried to obstruct a fair process from the beginning.
 

There's so many ways of critiquing the injustice of this decision that the judgement should never have been safely arrived at.

This is a political stunt and Everton are the scapegoats. The whole of football knows it.

This cowardly judgement on behalf of the craven Premier League is a disgrace. Now there's talk of relegation for City and Chelsea - and that's what this was all about. City and Chelsea will pay a hefty fine and/or be relegated. It could in fact kill the league if the Scab 6 scuttle off.

A pox on the league. And also on Moshiri, Kenwright and Barrett-Baxendale for allowing it to happen.
 
They wouldn’t get close to £100m each. Price to 777 reduced and difference used to fund compo. Given Mosh’s culpability he should fund entirely himself and the “company” should not. The compo isn’t a sporting penalty so there would be no need to punish the club and ensure its club funds that settle it. It’s purely to put those that lost out back to where they would have been. If he had any pride he would find completely.

Can’t see it happening. Most sensible commentators have said it would be batted away quickly.
Would those settlements be included in the FFP calc so we would fail again and get a further penalty if we stay up or perhaps we would be let off as deemed a mitigating factor.

Yep. They feared a legal case by other clubs and wanted the hot potato out of their laps.
