Except that it wasn't the Premier League who imposed the penalty. It was an independent panel. At least be factual if you're going to down the Redscouse Victim Route (and the irony of a red coloured flag...).
The independent panel who had the Premier League whispering 12 points in their ears before showing them a newly-created document showing how to deduct 10 points.

Be a massive ad break for our cards being held up on Sunday then a close up Maguires head on 10 minutes.
 
Might have already been asked but, once the appeal goes in officially will the points be reinstated until the appeal is heard or remain "lost" until the appeal is heard ?
At the moment, as the appeal has not been formally made, there is no reason to not make the points adjustment.

If you are banned but appeal you can play until the appeal so wondered what the position is with points as may have a physiological impact on our players and other teams.

But you've accepted that you broke the rules, what you are contesting is the size of the penalty. Anything else is white noise. An independent panel chose the sanction and whether it is too high is what will be addressed. Shouting about how unfair it all is is more of your neighbours' approach to anything. i know this is raw for Everton fans (I'm a Villa fan), so am of course able to see it without the emotion involved and I appreciate that i won't appreciate how it affects you as fans of Everton. That said, the deduction this season is a lot easier to bear than any other season and in all reality will have zero impact on the bottom three this season.

This will also act as a useful barometer and precedent (not that you'll care one jot about this point and I understand that), for when it comes to applying sanctions on anyone else. You're guilty of one thing - 10 points; if anyone else is guilty of more, lets say 115 things, the penalty will be pretty brutal.
well, we didnt think we broke the rules and gave our reasons why, Player X, Player Y, C19 restrictions, Stadium costs and the sanctions imposed by HM Govt on our main sponsorship streams. Once those reasons had been (unfairly) thrown out, that is why we then had to form the view that we had broken the rules. Had those mitigation been accepted as reasonable, we then don't break any rules and all of this goes away.

I don't know the answer, I think anyone does but personally I'd like the 10 points to remain deducted until the outcome of an appeal is known. I'd rather have the players going out on the pitch with the mentality that they have 10 points to claw back than assuming we're going to be OK as long as the appeal goes well.

I've also heard rumours of the points deduction being changed to a suspended sentence following the appeal. That would be an even worse result. I'd rather take 10 points this season than any other season. If we took a suspended sentence then got charged again we'd be faced with 10 points plus more for a further charge and that would definitely be too much to survive.

Mate you didn’t get points deducted for a sporting advantage of having a goal disallowed and another team going down because of it.

We are getting points deducted for an accounting issue by an ‘independent’ commission with people connected to Leeds and West Ham, one stem that is trying to sue us, the other was a director when they had Tevez and Mascherano and didn’t get a points deduction.

The chanting will go on for ages at the start and on 10 minutes (and probably very dubious refereeing decision as well). There’ll be no getting away from whatever Sky do short of not covering the game.

No, technically, we have been found guilty. We can appeal but until that is successful the points won’t be reinstated.

Great stuff from them although hopefully they rethink this one as it’s not accurate- it’s grown legs but they did actually say there was an implied sporting advantage.

If we want people to pay attention to these protests they have to be based on accuracy.

I'm not presuming anything. I'm merely saying that we know the figures for the past 2 yrs and there are estimates for this year. Debt restructuring or other financial/transfer activity may yet move that figure...... so given those and our ongoing situation, there IS a possibility of a further infringement. I haven't said it's a certainty.

As regards mitigation. Our actual losses were approx £380m. These were whittled down to £124m by applying mitigation factors including our claim for Covid losses which were comfortably the highest in the league.
But you are presuming. You can use the word 'estimate' to put a gloss on it if you wish, but you are literally presuming what's gone on prior to the accounts being published.

As for mitigations: yes the club rightly claimed for Covid in that sense...something the PL allowed for. I don't know, maybe you feel on other major mitigations like the club losing sponsorship deals because of a war was something they could have planned for...as per the Commission?

The whole thing has been subjective. As I said, there's no application of science here. No straightforward measurement of what gets you in trouble and what doesn't. And that feeds into my point that the PL has scope to charge or not charge Everton next time around. It will be a CHOICE, not something they'd do by reading off supplied figures with their own guidelines..as pathetically woolly as they have been.

In a nutshell, that could simply resolve the lot. Something like this. Not going to happen like :)

“Thanks for the independent investigations findings, but after reviewing the facts further with the help of Everton and other external enquiries, we are immediately reversing the points deduction, but instead will be working more closely with helping Everton with their financial issues - not punishing their fans unduly; as that is surely the primary aim of profit and sustainability. However, the 10 points will be suspended for 2 more seasons (this and 24/25), as this is still a serious matter and we also have other clubs interests to think about, including relegated clubs, but as the previous 3 years have shown a vast improvement, we dont believe any deduction will be applied.”
