They could say well as there was no sanctions in place for this 'crime', so EFC can have a slap on the wrist and this will be the penalty for this type of behaviour going forward. Exactly like they did with the scab 6 - oh its all OK this time richest clubs....but if you do it again we will deduct 30 points. Absolute farce!
 
there's probably no merit in going down this line unless he is still in the employ of Leeds (or was at the time of sitting on the panel) as barristers routinely act for different clients on opposing sides of arguments (prosecution one week, defending the next).
I don’t disagree with what you have said, I regularly work with barristers and can find myself in opposition to one who has been on my side in the previous case. I would recommend that his pronouncements on Leeds United outside the case are looked at to see if his interest in them goes beyond the normal client attorney association. It is extremely important the appeal system is squeaky clean, it needs to be fair and it needs to be seen to be fair.
Side issue, “If we appeal do we get the 10 points back until the appeal is heard”?

The PL have said that they bought forward a motion about creating standard sanctions for a breach of P&S and it was voted against by all clubs.
 

Just a minor point .... but there's nothing to stop the appeals panel adding extra points

This is the problem.

The Commission were supposedly working to PL "guidance" for breaches of PSR which are 6 points for breach plus 1 point for every £5m over (so technically, we should have been done 9.9 points)

If you assume that the tariff remains unaltered then what happens if the appeals panel find out that we are £30m over (or they are instructed to)?

Not saying it will happen BUT personally I wouldn't hold my breath for any big points reduction

(In fact, it may be better to think "ok, it's -10 and go with that mindset)

The points deduction could be added to - 12 points as the PL wanted
The points deduction could remain the same - 10 points - the appeal case finds we have no argument.
The points deduction could be reduced - The appeal finds we have some grounds that the amount of points was too harsh.
The points deduction could be wiped out - Very unlikely and they fine our "wealthy" owner. And when they say "owner" they mean the club.
Surely that would have to be stated in the appeals process.

I think people are still failing to see the difference between accepting guilt and the penalty applied.

Ditto the penality is hugely out of proportion with the offence.
Ditto the penality is a sporting penality when it should be argued the club should face a financial penality.

Also needs bearing in mind that there are a number of holes in the Premier League case, from a layman's point of view, from what I've read the PL changed the rules on some of the mitigation (re the stadium costs) at that point Everton were saying we did nothing wrong to then having to accept yes we have now breached the rules.

From a legal point of view you only have to see what many experts are saying and that includes Andy Burnham.

Anyway it'll all come out in the wash as they say. What is clear is that an Independent Regulator is on the way. The PL can try to bury us (I hope we bury them)
I think it's only a matter of time that things change. I just hope it's not too late for us.

This is how the manager players and fans should be looking at it, forget about the -10 points we are 5 points away from getting out of it with 25 games to go, its very very doable in fact i would be massively disappointed if we didn't given the sides we are currently competing against.

Let the club deal with the appeal and if we get it reduced then great but if we dont then we need to be in position where it wont effect us.

Everton are preparing to submit their accounts from the 2022-23 season to the Premier League — clubs now have to do so before December 31 instead of March. Under new regulations brought in during the summer, straightforward breaches of financial rules will be fast-tracked so they are dealt with before the end of the season.

There are fears that if the same calculation system is used, Everton could find themselves sailing close to the wind again.

If we have lost more than £105m in the last 3 years when we have been net positive on transfers, then the club deserve everything they get. We, as supporters still shouldn't be punished though as its still not OUR fault.
