Fair enough, but I don't see how the point in bold works in our favor, as it's clear the league wants nothing more than to hammer us particularly. How independent will the appeals board be?

Along with everyone else, I think the punishment is insane and wildly inappropriate. But it does at least seem to be based on a structured standard that is allegedly supposed to apply to everyone going forward. We were obviously chosen as the example club to begin using those new standards, unfortunately for us.

That's all I'm saying - in order for us to get out of this, it seems like we have to get the appeals board to essentially throw out those new standards, because we did in fact already admit to the breach. So we can't just come back now and say, whoops, never mind, we didn't actually do anything wrong.

Trying to stay level-headed here and think about this through something less than the fury we're all feeling right now.

Because they've got Chelsea and City next up and they will appeal anything thrown at them (unless it's a complete farce).

So to have an appeal body they just agrees with the league 100% wouldn't be seen as a fair appeal body.

The sanction is disproportionate - that's the issue for me.
When the sanction is worse than that of skipping off your bills and going into administration.. then there is something majorly wrong.

What’s clear is that we showed an intention to stay within rules, we were transparent with the league about it but certain unfortunate events have taken us outside of it marginally. Everyone can argue about whether Everton deliberately did this and we’re definitely a shambles but a transgression worthy of a 10 points deduction? No chance.

Even if we’d just have been fined the amount we were over the limit that would have been a harsh fine but a points deduction of this size is ridiculous. I hope we don’t even settle for having it reduced to 6, we shouldn’t have any.
 
It signs off transfers dealings. The point being is that if they knew about our finances (the previous years accounts were far more eye watering) they should've implemented something sooner rather than "work" with the club.

To come out at the time and say we were compliant when other clubs were threatening to sue means they were closer to the financials than you'd expect.

Basically they were the passenger not flagging up to the driver they're about to crash.
Player purchases and sales are only part of the accounting. It’s not as if the PL have their trial balance accounts or are controlling cash. It’s not their job to sanction purchases and sales, made clear in the report. It’s their charge to review the annual accounts given by the clubs an determine if there are breaches.

EFC are responsible for their finances and compliance. No one else.

From the start we had gone over 105m. The investigation was about whether there were reasonable circumstances to explain some of it away.

It none of the 'excuses' would matter, they why even have this independent commission in the first place?

The better argument, though unpalatable, is that the FA unjustly suspended him without true due process.
 

My concern now is an appeal. If we appeal then it would have to be quick as say if we are in the relegation zone on 34/35 games, they then wouldn’t allow an appeal to jump us over other teams and save us. They would have a nightmare on their hands again with a team being relegated.
 
This is a farce and equally unfunny.

we should just not cooperate at all with the Football authorities, wherever we have the choice.

also, they cannot silence the fans, there should be some continuing reaction in every game this season - home and away.

But the thing that worries me about the Chelsea and City cases versus ours is that - for all the sheer number of charges they both will have - they're not the same kind of charges ours were, right?

I mean, ours was a straightforward spending of too much money versus our income. Whereas Chelsea and City are accused of skirting the rules using fake companies, subsidiaries, etc. rather than just spending too much in general, unless I'm mistaken.

So while their actions are obviously much more ethically fraught than ours, because they are not the exact same type of actions, they might not be looking at the exact same type of punishment. Maybe they give them something other than a points deduction, thus leaving our case to stand more on its own?

I'm under no illusion that all of this will be treated fairly, but you can already see how the unfairness will try to be justified by the league and other authorities - different crimes, different punishments.
 
In appeal world, quite quickly. Deffo by season end, (obvs). Its the 10 points we are appealing, not the breach, and the general view everywhere seems to be that its a bit nuts.
Yeah, I know public perception won't formally be considered, but I'm surprised by the reaction from most neutral commentators and even normal fans. I thought there'd be a degree of delight / hilarity at our misfortune but actually most see it as the disproportionate hypocrisy / scapegoating it mostly is.
