City already have been found guilty by UEFA and banned from European competition. Was overturned due to the allegations being time barred.

Theres already evidence to suggest City have broken rules. The premier league now accuse them of 115 breaches.

Everton were in breach of 1 rule which is due to opinions based on audited accounts.

But you know what they'll get? 10 points. Ours will get reduced on appeal...City's will stick. But 10 points to city is nothing.

Add to the fact City's breaches have been discussed by the government with Qatari officials is another reason why they'll get off lightly

Wait what... when did that happened (btw I guess you mean the UAE)? If true, it's one of the reasons I don't want the gov having a controlling power over the PL or lower-leagues. They'll use it to their benefit, especially the Tories.
 
Just catching up with this now. Surely City and Chelsea must be facing relegation if the bar has been set with our punishment and for one relatively small breach. That said, unless this is truly independent there feels like no chance that the Prem would see two of its cash cows sacrificed. The relegated teams are going to be going at this to, such as Tevez, was it? What a mess but typical ofour luck.
 

What’s clear is that we showed an intention to stay within rules, we were transparent with the league about it but certain unfortunate events have taken us outside of it marginally. Everyone can argue about whether Everton deliberately did this and we’re definitely a shambles but a transgression worthy of a 10 points deduction? No chance.

Even if we’d just have been fined the amount we were over the limit that would have been a harsh fine but a points deduction of this size is ridiculous. I hope we don’t even settle for having it reduced to 6, we shouldn’t have any.

We're in breach mate, i think we tried to chance our arm and didnt get away with it. Its the proportionality of the sanction to the offence and what they look at as aggravating factors - i have an issue with.

If im absolutely calling it, here's what i think - i think we absolutely were in breach the year before this charge and the PL colluded with us as their rules around Coivd were very subjective and open to interpretation - if they took action against us, they would have had to around others to and they didnt want to do that. They got huge heat from Burnley, Leeds and Watford that year and it left them exposed. I think they made up their minds then that they would do something.

Under increased scrutiny last year they found a minor breech, so for the above and other reasons ill describe below - are now after handing out a huge disproportionate punishment. Its as much about the financial year before the charge as the one we we were in of in my opinion.

I dont wholly believe this has been dished out on the actual offense, its partly due to taking the mick out of them because our Covid losses, partly the heat they are getting from the relegated clubs, partly our dubious links with ownership and partly the regulation piece.

We played right into their hands with our hubris and incompetence. So essentially weve got a couple of years in jail for crossing the road when their wasnt a green man.

The only game in town now is protest - making a show of the PL and aim for the appeal on the basis of proportionality.

Wondering why tomas partey was allowed to continue playing whilst there were very strong allegations against him investigated by the police. Unless everton was a first and a last...as per usual.
For reasons I won't go into here I know a bit about Sigs case and there was zero chance he'd be convicted. Mendy was someone who was suspected of lots of things and his injuries were minor things to keep him out the spotlight. Jonny Evans and Rio Ferdinand were accused and it was brushed under the carpet. Add to that Liverpool's doping, Manes suspicious transfer to Bayern, Countiniho going from world beater to Niasse in the space of months.
 

Player purchases and sales are only part of the accounting. It’s not as if the PL have their trial balance accounts or are controlling cash. It’s not their job to sanction purchases and sales, made clear in the report. It’s their charge to review the annual accounts given by the clubs an determine if there are breaches.

EFC are responsible for their finances and compliance. No one else.

It's not about them being in control of the finances, it's the idea to take action if they feel a club are heading a certain direction. Hence why we were in close communication.

If this wasn't the case, we'd have spunked more money rather than be the lowest spenders in the league for about 3 seasons.

But by your and I'm guessing the commission opinion, the club was spectacularly naive to even be in close communication with the PL in regards to our financial situation. Because it was the belief that if there were any worries and concerns the PL would've advised or intervened.

They didn't. Other clubs threatened to sue but the PL responded by saying we were compliant.

If being in communication with the PL meant nothing we wouldn't have done it.

We really are a shambles some of the things we tried to blag and include in like the 4%Transfer Levy . So we believe we’re “ £7.9 mill over” , so guilty . The Commission believe the PL that we‘re £19.5 mill over. The PL suggested a points deduction based on 6 points if over plus 1point for every £5 mill over , so 10 points on that formula. The Commission rejected that formula , but surprise surprise said there was no mitigation , here’s a 10 point deduction.!!

It’s difficult to see how our appeal will work . “ We’re guilty, but it’s harsh with no real mechanism for working out what the punishment should be” seems to be the only way .

There is also the suggestion in there that 12 points is the maximum sanction. If so the likes of City and Chelsea may just accept a one season 12 points and settle out of court.
