Yeah, the clauses in the contract would not be fulfilled but equally anybody could also offer him a contract. If he's good enough to have earnt a new contract with us, he's gonna be good enough for someone else.
If he’s such a top geezer he’s surely ignore those overtures and repay his gratitude. Wouldn’t he????

I get why you have said that mate, but whilst I have every sympathy for the lad and his struggles, it is this level of sentimentality that has us where we are. Spurs took a commercial decision, we have all been saying for years that we have to be run more like a business than an old boys club. So lets us help him in every way we can, but unless he agrees to sign a new contract on a pay as you play basis, then in my opinion we get rid of we can, whilst still letting him know our medical team etc. is there for him anytime he wants.

Also what happens if we don't meet the appearance thresholds to pay past, say the first £20 million before Jan 25 and he then becomes a free agent... are we free to snap him up again without further payouts to Spurs? If that's the case we can promise him a new contract but not sign him up until his existing one has expired?
I like your thinking, but with near certainty there would be a clause in his contract to prevent this.
 
I don’t think insulting people for their views is the right way to approach this, we don’t know each others mental states and we should be able to debate something, however controversial, without reverting to name calling, let’s try to understand why someone feels / thinks the way they do and not berate them. Having a debate in writing is tricky due to the tone not being understood.

Whether we like it or not, there are two key components that conflict directly. The human element and the financial. It’s simple to say that, in such awful circumstances, money should not form part of the equation but it does and by the millions and the real irony here is that his road to recovery could hinge very much on money.

For example, we saw the awful tragedy of Emiliano Sala who suffered the worst possible fate on his way to Cardiff. Years later what has it resorted to, legal battles over money. It’s life, ugly as that may feel to people.

The agreement we have with Spurs will prohibit Dele from getting a decent run of games, if he’s able to do so, as we simply don’t have the money and even if we did, I’m not sure it would represent a wise investment.

To just pay the money to help him, as has been suggested, isn’t right to me either, there are many people who have been through similar and worse and I’d sooner see the club donate the money to help many people affected by abuse and addictions.

In terms of Dele specifically, if the experts belief is that his recovery would benefit from playing football then perhaps his representatives could reach an agreement with Spurs to deal with the first instalment between them? Dele’s mental health is the real priority here and if it’s me, I would pay whatever I could afford to get the help I needed and to provide the best possible environment for me to feel happy.

Alternatively, there may be some sort of agreement to be had with the Premier League to disallow a negotiated payment made by us to Spurs from the P&L, given the unique situation?

what's with this "sentimentality has got us where we are" narrative? p--s poor recruiting and financial mismanagement has got us where we are.

I don't disagree mate, but bringing the likes of Rooney, baxter et al doesn't help either. Some players, managers etc. could be certifiable basket cases and they would get a free pass form some of our fans provided they thought the individual ‘g
 

I can't believe some people are actually saying that we should be willing to consider keeping him, even on some alternative deal. He's been dreadful and has offered nothing. We aren't in a position to keep carrying players in the hope that they may come good. Spurs couldn't wait to offload him. He needs time sway from football and away from us

Sentimentality of bringing back former players who are past it etc is different to supporting a current player.

if it does play a part in our demise, i reckon it's a tiny fraction of possible reasons. i think we should give dele the chance to display what he's capable of. if he shows any promise of getting back to any kind of form that could help us we should consider paying the 10 million. i just don't see our decision makers to bring in someone for the same money who can do a job.
 
Been wondering if Spurs knew about Dele's addiction when they sold him to us. In the interview he mentions speaking to his best friends, Dyer and Kane about his issues so suspect that if he told them of his addiction they would have felt obliged to tell the management. Mourinho's comments about him not fulfilling his potential and calling him lazy then seem explicable if he knew Dele had this problem. So if Everton didn't know and Spurs did, but they didn't tell us about it, then could Everton argue breach of contract? We would have done physical tests but presumably sleeping tablets wouldn't show up on any testing - so if we weren't told about it how could we know? If we could argue breach of contract then could we sue them for return of monies we have already paid them? Had we not paid them whatever we have paid so far then presumably we wouldn't come close to breaching FFP. If it was found out that they didn't reveal to the buying club that they knew the player that they were selling had a drug addiction then surely the Premier league would have to take the severest action against them. Even the threat of litigation and punishment by the Premier League would surely prompt them to reach an agreement with us.
I think Spurs have come out of this looking a bit grubby, for want of a better word.
