I did think it was widely reported that we haven’t been able to spend a dime without PL sign off? Mad they did give assurances to Burnley and Leeds. Surely nothing has happened since then given the negactive net spend?

but in civil cases they do, and this is technically a civil case, yes its not in a civil court but its still a civil case
It’s not akin to a civil claim either. It’s a private tribunal with its own rules. I do think it’s unethical for the Premier League to be asked its opinion on punishment (if they were) when liability hasn’t been determined. Surely the punishment should fit the findings of the tribunal.
 
I’ve said this before, but we’re in trouble here because we’re the Goldilocks club that’s just right for making an example of.

We’re big enough for people to sit up and take notice when we’re punished, but not big enough for the vested interests that power the league to care about protecting us.
We really need to stop playing the victim here. If anything happens, we have to be grown up, understand what has happened and suck it up. They don't simply hold these investigations to make people sit up and take notice. They do it because they believe they have facts and evidence of wrong doing. We can absolutely challenge any findings and explain them but please lets stop believing it's because we are Everton. Other clubs have been docked points in the league. If it happens to us, it is because our management has failed us again.

Absolutely failed us again. There was a stink of malfeasance off the club and some of its actions like the 30M payment to be put on a waiting list for naming rights, or having our auditors walk away and not being willing to certify the accounts. I don't really fear the PL verdict on this, its more the gates it might open to the relegated clubs to drag us through the courts and the impact that will have on the club on its ability to focus on what happens on the pitch. There's very different rules in play there, and we haven't shown an ability to single-task well, nevermind simultaneously concentrate on a takeover, a stadium development, a board re-org, and a court case that could cost us many millions in both legal fees and penalties.
 
On the question of how the Premier League can propose a penalty, see the Times today;

“It is understood the Premier League believes a breach of profitability and sustainability (P&S) rules should carry sanctions up to a points deduction.

In such cases, an independent commission will take submissions from both parties in the case, the Premier League and the club, on what they believe an appropriate sanction should be if a rule breach has been proved, but the decision is entirely at the discretion of the commission.”
