Oscar Pistorius trial discussion

You're missing the point.

The prosecution are pushing for premeditated murder, and so far they've done nothing to prove that over Pistorious' version of events. You can't sentence somebody based on what you believe, it's what you can prove. This isn't civil court.

I don't actually know if he's guilty or innocent, none of us do. I'm simply pointing out that all these people claiming he's guilty as sin based on paper talk and a couple of days of bail hearing are being ridiculous.

I've not missed any point.

He's shot his girlfriend - fact. He's admitted to it - fact. He's claiming it was an accident, with a feeble story backing his claim. His story lacks credibility, as it's non-sensical for a whole host of reasons & anyone with an ounce of common sense would doubt it's validity, so therefore no-one is being 'ridiculous' for having an opinion as to his guilt, given the facts that are currently in the public domain. For him to excuse this murder as an accident, the reality is that it's him who needs to convince the Judge that his version of events is the truth, the proof is already there, she's dead, it was his gun, his house & he pulled the trigger.

The prosecution are going after him for premeditated murder, which is what they need to prove. Double jeopardy exists in South Africa so if he's found innocent of that as far as i know he'll be a free man. All the defence have to do is place considerable doubt on the idea that Pistorius decided in advance to kill his girlfriend. Based on the shambolic prosecution case thus far i can't see that being a big struggle.

'In advance' in this case, means the time it took to pick up his gun & walk to the bathroom of his flat, nothing more.

The prosecution have had no time to make their case water tight yet, so his expensive defence lawyers are poking holes in some of the loose ends, which is totally understandable at this stage. Personally I think the actions of the man since the poor woman hit the floor are deplorable.

What actions

He's guilty as sin, the murdering [Poor language removed]. But just like that witch Knox he'll get off with it. Money trumps justice just about every time.

agree mate its a disgrace, Im a gun owner and in that situation first thing you would do is check where she is even if it means putting a light on.

Yesterday in the bail hearing, for example, Pistorius's attorney got the police investigator to admit the following:
  • The investigator had no evidence that disproved Pistorius's story
  • The investigator had made a mistake in describing a drug found on the scene as "testosterone" (it may be a legal "herbal remedy)
  • The investigator did not wear protective booties in the house, thus "contaminating" the crime scene
  • There was a good reason Steenkamp might have gone to the bathroom other than that Pistorius was trying to kill her (her bladder was empty)
  • Steenkamp had no defensive wounds on her other than the bullet wounds--there was no sign of a pre-shooting fight.
  • The "trajectory" of the bullets through the toilet door are not inconsistent with Pistorius's story that he was not wearing his prosthetic legs when he fired the shots
  • One of the witnesses lived as far as 600 meters away (the prosecutors later challenged this)

Pretty damning really.

As mentioned previously, the fact that his brother & a brief were in at his house before the emergency services, which means his immediate priority after realised he'd 'accidentally' shot his bird - 4 times through his bog door, wasn't to ring for an ambulance.......the poor girl wasn't even cold before his 'people' were spreading his bs 'intruder' defence story via social media, before the news channels had even broken the story......
