I'd have to bow to actual contractual experts on here to be honest but I have been put on gardening leave previously and was just paid my wage for remainder of contract monthly until end of contract.

I'd imagine any payout for termination of contract would either be immediate payout or negotiated on exit.
 

Hope the club don't do a Lampard and wait until after the next international break to act, assuming we're still in the mire.

Apparently the bobble has said it will cost 7/8 million to sack Dyche as he has it in his contract, even though he has 8 months left.

If results don't improve then Moshiri will still step in
Yeah that does shock me how much he actually gets paid by us is another reason to question if he should get a new deal
 
We have thrown that much money away on crap players and managers the last few years, 7 or 8 million is nothing compared and especially if it means averting a season of gutter dwelling, frustration and disappointment in the final ever season at Goodison. That is where we are heading with this fella at the helm.

He doesn't even hide the fact that his seasons aim is to stay in the league and the problems existed before came, blah blah blah. Absolutely pathetic, any decent manager should have higher aspirations than that. Team showed in the last game that they are capable of more and at minimum a non relegation threatening season and mid table finish if they were managed properly. Not with this loser at the helm though, he couldn't run a bath.

Well you are very sure but I presume that like me you haven't seen let alone read the contract.

I would agree that in the vast majority of contracts that putting someone on gardening leave would get around a clause that reads something like " an extra years salary is payable in the event of the contract being terminated prior to the end date of this fixed term contract".

However if Dyche's lawyers were smart they might have insisted on the payment taking effect if Dyche was ever relieved of his duties - in which case gardening leave won't work.

Dyche could also argue that putting him on gardening leave gives rise to a constructive dismissal and bring a claim for any monies he considers due. If he does that however he will be tied up in litigation for years.

I wonder how Bobble is apparently so sure of the position - perhaps he has been briefed by Dyche's camp - in which case who knows how accurate such a story might be.
