Times article, Burnley/Leeds threaten to sue Everton

Burnley and Leeds want Everton's finances thoroughly investigated and have asked for an independent commission to be set up to decide whether Everton have broken Premier League rules and whether they have a case to answer.

They have asked for the commission to be set up within six weeks of the date of their letter (May 13).

If there has been a breach they want rules to be enforced, and the maximum punishment is a points deduction.

They want this dealt with before next season's fixtures are released on June 16. They want a quick resolution - unlike the Premier League's investigation into Manchester City's alleged breaches of financial fair play rules which have been going on for more than three years.

There is believed to have been encouragement from other Premier League clubs to take this course of action.

I do always wonder what legal weight could be behind any attempt to sue an organisation you have voluntarily signed up to, and that isn't a public body. Unless it's they've flagrantly breached some contract with the clubs one would expect the Prem has already acted within it's discretion to not deduct us points.

What cause of action therefore do Burnley or Leeds have ( if anyone knows)? I don't recall how the Man City one ended up in court either unfortunately...

Everton have already answered the premier league. This is just desperation from a soon to be relegated club. They are grasping for whatever they can.

As far as I know, no club has ever breached the Premier League P&L rules before.

Interesting point that, how did it pan out legally when Juve got kiboshed for buying penalties then the title was removed and they were also relegated? There must have been associated harm somewhere in the league?
 
Let’s be honest, if we hadn’t been involved in a relegation fight with both of these teams for the past few months and say finished comfortably top half, neither of these clubs would be crying to the PL about us allegedly breaking any rules.

Pure straw clutching and sour grapes from both of these clubs.

I get it, I was distraught at the thought of relegation too and would’ve been looking for any way out. I’d have been hoping the club took the PMGOL and the PL to the cleaners for their inept officiating which would’ve undoubtedly been a factor in our relegation, but that wouldn’t have made a difference either.
 

The suggestion is that it’s not just those two that are gunning for you and whilst the only other club mentioned was Arsenal in April it was reported that far from the matter having been resolved legal action was being talked about even then.
I guess they can do what they want. In the meantime we have provided our accounts to the Premier League and they have decided otherwise. Kind of sad.
