6 + 2 Point Deductions

I hear tell that FAB are calling a war council of the various Everton tribes for midweek. Anyone else hearing this?

Let's see if they try and nudge this toward pacification or if they're up for the fight. I always thought they did the former during the War Against the Board.

Be vigilant. Resist any cave in. UTFT.

I agree but to me, and just my opinion, it looks very similar to the EFL system. I don't know why it wouldn't be as all clubs, particularly those going up or down should be party to the same system. I find it very strange that English football can't get its act together in this regard, they have had long enough after watching City and Chelsea take advantage.

Perhaps, but they specifically wrote they did not use any guidance other than their own discretion.

As I replied to you in another thread, there's way too much uncertainty around this process and the outcomes.

Conflict of interest from David Phillips KC = case thrown out and disbarment

Every minute this gets stinkier than Trevor's corpse under the Brookside patio.

Surely Everton would have been told in advance who was going to be on the commission making the decision? I don't believe for a second that Everton only found out once the decision had been made that one of the panel was involved with West Ham at the time of the Tevez scandal and this fella is a lawyer for Leeds Utd.

We are stupid but surely we aren't that stupid? We would have been shouting from the rooftops before the decision was made that it stinks to high heaven if they knew who was on the panel.

I’m not so sure this is a big deal and there are other issues with the judgement that should maybe be focussed on. Sports law is a pretty limited field with a limited number of clients so over a career I imagine a lawyer will represent plenty of different clubs. Unless he is still retained by them (I don’t know if he is or isn’t) the fact he once represented them 15 years ago doesn’t infer any lifelong affiliation or anything.

Yeah, I don't think representing Leeds 15 years ago precludes him from working in football again.

Besides, his name is on the report, and Leeds don't realistically stand to gain anything from this other than spite or a few million quid. They weren't the party aggrieved here in actuality. He isn't going to ruin his career and future earnings with nothing to gain.

My older brother told me Denise Baxindale was asked by our club after her nassive severance pay from the club to help us as a witness being involved in the first investigation by the premiership- she declined to help us by refusing to turn up at the independent inquiry ....absolutely disgusting if true....

She should have been put in a headlock and dragged there.

She had been sacked. Regardless of payoff, she could have done a lot of damage.

There is no access to CAS. And isnt it the case that we’d break PL rules if we took this to court? And wouldn‘t this lead to expulsion? (May have imagined this last bit, but I’ve always thought it was the case)
I'm not sure a 'club' rule that contravenes the law of the land would stand up to scrutiny if challenged. Thats why Bosman succeeded, it was fine til someone challenged it. The law will largely want to keep out of this til someone raises a case of restriction of trade or suchlike. Then all options remain open no matter what the PL say.

Yes, but it’s the timing ……if they feel like jumping ship in January, we’re stuffed

The cynic in me says they'll stay, if only for self interest. Our better players are in contention for Euro 2024, they aren't leaving guaranteed playing time for an uncertainty.

They have nothing to lose, if we go down it's not their fault. If we stay up they're heroes.

Why ask her then ? she had been awarded a massive payouts = 90 million combined with the other members of the board sacked ?... damage was shocking without her tbh if she was a hostile witness the clubs legal team would never have asked her ....

You wouldn't put it past our owners not to be that stupid. Also one of the other " Judges " on the panel was a Director on the West Ham board who was there during the Tevez/ Macherano scandal, he then thought it should not be a points ban for WHU, just a fine, but t felt the opposite for Everton. Deep corruption, hope it costs Masters his job, it should do the back stabbing swine.
